CONCERNING
AMENDMENT TO DECREE OF THE MINISTER OF FINANCE NO. 580/KMK.04/2003 ON THE PROCEDURE OF GRANTING AND SUPERVISING IMPORT FACILITIES FOR EXPORTS

THE MINISTER OF FINANCE,

Considering :

• a. that the process of refunding import duties and/or excises already paid within the framework of import facilities for exports requires a complex study due to the fact that import documents must be integrated with export documents;
• b. that to process applications for refunds on import duties and/or excises already paid within the framework of import facilities for exports needs adequate time;
• c. that based on the considerations in letter a and letter b, it is necessary to stipulate a Regulation of the Minister of Finance on Amendment to Decree of the Minister of Finance No.580/KMK.04/2003 or, the Procedure of Granting and Supervising Import Facilities for Exports;

In view of :

• 1. Law No. 10/1995 on Customs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612);
• 2. Law No. 11/1995 on Excise (Statute Book of 1995 No.76, Supplement to Statute Book No. 3613);
• 3. Law No. 17/2003 on the State Finance (Statute Book of 2003 No. 47, Supplement to Statute Book No. 4287);
• 4. Law No. 1/2004 on the State Treasury (Statute Book of 2004 No. S, Supplement to Statute Book No. 4355);
• 5. Presidential Decree No. 187/M/2004;
• 6. Decree of the Minister of Finance No. 453/KMK.04/2002 on Customs Procedure in the Import Sector as has been several times amended the latest by Decree of the Minister of Finance No. 112/KMK.04/2003;
• 7. Decree of the Minister of Finance No. 557/KMK.04/2002 on Customs Procedure in the Export Sector;
• 8. Decree of the Minister of Finance No. 580/KMK.04/2003 on the Procedure of Granting and Supervising Import Facilities for Exports;
• 9. Decree of the Minister of Finance No. 606/KMK.06/2004 on Guidelines for Making Payments in the Realization of the 2005 State Budget;

DECIDES:

To stipulate :

REGULATION OF THE MINISTER OF FINANCE ON AMENDMENT TO DECREE OF THE MINISTER OF FINANCE NO. 580/ KMK.04/2003 ON THE PROCEDURE OF GRANTING AND SUPERVISING IMPORT FACILITIES FOR EXPORTS.

Article I

Provisions in Article 18 of Decree of the Minister of Finance No. 580/KMK.04/2003 on Procedure of Granting and Supervising Import Facilities for Exports shall be amended so that the article entirely reads as follows:

" Article 18

The applications as meant in Article 17 shall be processed for approval or refusal within a period of 30 (thirty) days after the applications have been received in a complete and right manner, excluding a period of time needed to conduct an audit: "

Article II

This Regulation of the Minister of Finance shall begin to take effect on the date of stipulation.

For public cognizance, this Regulation of the Minister of Finance shall be announced by placing it in the State Book of the Republic of Indonesia.
